These Terms of Service ("Terms") govern your use of applications and services provided by Vyomio ("we", "us", "our"). By using our products, you agree to these Terms.
1. Use of Our Services
You may use our services for personal, non-commercial purposes. You agree not to:
- Use our services for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract source code from our apps
- Interfere with or disrupt the integrity of our services
- Create automated scripts to access our services without permission
- Resell, redistribute, or sublicense our products
2. Accounts
Some features require an account. You are responsible for maintaining the security of your account credentials. You may use our apps without an account (guest mode), but cloud sync and some premium features require sign-in.
3. Subscriptions & Payments
Free tier: Our apps include a free tier with core functionality. No payment is required for basic use.
Premium subscriptions: Premium features are available through monthly or annual subscriptions. Pricing is displayed in the app and on our website.
Billing: Subscriptions are billed through Apple App Store, Google Play Store, or Stripe (for web), depending on your platform. All payments are subject to the terms of the respective platform.
Cancellation: You may cancel your subscription at any time through your device's subscription management settings or via our app. Access to premium features continues until the end of the current billing period.
Refunds: Refund policies are governed by the platform through which you purchased (Apple, Google, or Stripe). Contact the respective platform for refund requests.
4. Your Data
You retain ownership of all data you create within our apps. We do not claim any intellectual property rights over your content. See our Privacy Policy for details on how we handle your data.
You may export or delete your data at any time through the app settings.
5. Intellectual Property
Our apps, including their design, code, content, logos, and trademarks, are owned by Vyomio and protected by intellectual property laws. You may not copy, modify, or distribute our apps or brand materials without written permission.
6. AI-Generated Content
Some of our products use artificial intelligence to generate insights, suggestions, or content. AI-generated content is provided for informational purposes only and should not be considered professional advice (medical, financial, legal, or otherwise). You are responsible for how you use AI-generated content.
7. Availability & Changes
We strive to keep our services available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Core functionality (offline features, local data access) will continue to work regardless of service availability.
8. Limitation of Liability
To the maximum extent permitted by law, Vyomio is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.
Australian Consumer Law rights are not excluded or limited by these Terms.
9. Indemnification
You agree to indemnify and hold Vyomio harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of our services.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, subject to your rights under the Australian Consumer Law.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of our services after changes constitutes acceptance.
